Permasalahan Lapas di Indonesia sampai saat ini belum bisa teratasi dengan tuntas. Program CSR merupakan sebuah peluang yang bisa menjadi salah satu alternatif pemecahan masalah pemberdayaan WBP di Lapas. Alasan utamanya yaitu permasalahan yang ada di dalam Lapas belum bisa diselesaikan oleh pihak pemerintah sendiri, dibutuhkan partisipasi dari pihak lain antara lain dari dunia bisnis melalui program CSR.
Penelitian ini bertujuan: (1) Mendiskripsikan pelaksanaan pemberdayaan WBP di Lapas Nusakambangan sebelum adanya program kemitraan melalui Corporate Social Responsibility PT Holcim Indonesia Indonesia Tbk Cilacap Plant .(2) Mengidentifikasi pelaksanaan pemberdayaan WBP program kemitraan pemerintah dengan Corporate Social Responsibility PT Holcim Indonesia Tbk Cilacap Plant di Lapas Nusakambangan. (3) Mengembangkan model alternatif pemberdayaan WBP melalui program kemitraan Pemerintah dengan swasta melalui Corporate Social Responsibility dalam upaya optimalisasi pemberdayaan WBP di masa depan.
Penelitian dilakukan di PT. Holcim Indonesia Tbk. Cilacap Plant dan Lapas yang berada di Nusakambangan dengan pendekatan studi kasus terpancang . Penelitian ini menggunakan 61 Informan penelitian. Data dikumpulkan dengan teknik wawancara, Focus Group Discussion, observasi dan studi dokumen. Keabsahan data diperiksa melalui perpanjangan pengamatan, meningkatkan ketekunan, triangulasi metode,triangulasi sumber data yang kemudian dianalisis dengan model interaktif. Sebagai pendukung data, peneliti melakukan penyebaran kuesioner terhadap WBP dan petugas Lapas di Nusakambangan. Responden diambil 10% dari jumlah WBP 152 responden dan 10% petugas Lapas yaitu 36 responden.
Hasil penelitian menunjukkan: (1) Pelaksanaan pemberdayaan WBP di Lapas Nusakambangan sebelum adanya program kemitraan melalui Corporate Social Responsibility PT Holcim Indonesia Indonesia Tbk Cilacap Plant masih kurang optimal. Hal ini dikarenakan: a. Dalam substansi hukum, yakni pada struktur organisasi Kemenkumham Bidang Pemasyarakatan, Direktorat Jenderal Pemasyarakatan (Ditjenpas) tidak memiliki pengawasan langsung kepada Lapas. b. Dalam struktur hukum, petugas Lapas yang diharapkan menjadi fasilitator sistem pemasyarakatan , masih kurang dari kualitas maupun kuantitas. c. Masyarakat masih memiliki stigma negatif terhadap WBP. d. Minimnya sarana dan prasarana proses pemberdayaan WBP di dalam Lapas. e. Namun hubungan sosial antara WBP dengan petugas Lapas dalam proses pemberdayaan WBP di dalam Lapas berjalan harmonis. (2). Pelaksanaan pemberdayaan WBP program kemitraan pemerintah dengan Corporate Social Responsibility PT Holcim Indonesia Tbk Cilacap Plant di Lapas Nusakambangan: a. Diwajibkannya Perusahaan Perseroan Terbatas untuk melaksanakan Tanggung Jawab Sosial dan Lingkungan dalam Undang-Undang No 40 Tahun 2007, dirasa tepat untuk kondisi Indonesia pada saat ini. b. Program CSR dibutuhkan dikarenakan anggaran yang dialokasikan pemerintah untuk pemberdayaan WBP masih minim. Diperparah dengan pemotongan anggaran yang dilakukan pada tahun anggaran 2014 tanpa alasan yang jelas. c. Masih terdapat beberapa masalah dalam proses pemberdayaan WBP antara lain: kurangnya jumlah petugas Lapas, over capacity, peredaran uang di dalam Lapas dan fasilitas “lebih” untuk WBP golongan tertentu, serta masih minimnya tenaga medis. d. Implementasi CSR PT. Holcim. Tbk. Cilacap Plant di Nusakambangan disambut positif oleh stakeholders dan selaras dengan prinsip Triple Botton Line dari Elkingto. e. program CSR PT. Holcim. Tbk. Cilacap Plant untuk pemberdayaan WBP di Nusakambangan meliputi : pengembangan kapasitas manusia, pengembangan dan kapasitas lingkungan . f. program CSR PT. Holcim. Tbk. di Nusakambangan memberi manfaat banyak pihak, utamanya bagi masyarkat WBP yang masih menjadi masyarakat marginal. g. Program CSR PT. Holcim. Tbk. Cilacap Plant untuk pemberdayaan WBP di Nusakambangan mencakup kebijakan, kelembagaan, ketenagaan, penyelenggaraan, pembiayaan, pengawasan, dan pengendalian pemberdayaan h. Hasil dan manfaat pemberdayaan program CSR PT Holcim Tbk Cilacap Plant di Nusakambangan dirasakan positif oleh inside stakeholsers dan outside stakeholders meskipun masih memerlukan pembenahan dalam implementasinya.(3). Model Pemberdayaan WBP melalui program kemitraan kolaboratif Pemerintah dengan swasta melalui CSR yang sustainable dalam upaya optimalisasi pemberdayaan WBP di masa depan diarahkan kepada a. Penguatan Kemitraan. b. Penguatan Tahap-tahap Implementasi CSR. c. Penguatan Pengembangan Pemberdayaan WBP.

Prison problems in Indonesia has be resolved completely. CSR program is an opportunity that could be one of the solutions of WBP empowerment in prison. The main reason that the existing problems in the prison can not be solved by the goverment it self. It takes the partisipation of other parties, among others, from the world of business through CSR programs.
The objectives of this research would be defined as follows : ( 1 ) To describe the implementation of the empowerment of the prisoners in Nusakambangan before the partnership program of Corporate Social Responsibility PT Holcim Indonesia Tbk Cilacap Plant is executed . ( 2 ) To identify the implementation of the empowerment of the prisoner between government and private actor through Corporate Social Responsibility PT Holcim Indonesia Tbk Cilacap Plant in Nusakambangan. ( 3 ) To Develop some alternative models for the empowerment of the prisoners through partnership programs between government and private actor especially by implementing Corporate Social Responsibility program in an effort to optimize the empowerment of the prisoners in the future .
This research was conducted in PT . Holcim Indonesia Tbk . Cilacap Plant and the prison which is located in Nusakambangan by using a case study approach. This research used a total of 61 informants. Data were collected by interview, focus group discussions, observation and the study of books and documents. The validity of the data is furthermore checked through observation, persistence, triangulation method and data sources triangulation were then analyzed with an interactive model.
The results of the research showed that: ( 1 ) The empowerment of prisoners in Nusakambangan before the partnership program through Corporate Social Responsibility of PT Holcim Indonesia Tbk Cilacap Plant is still less than optimal. This is because: a. In the substance of the law, the structural organization of ministry of law and human rights is considered to be less effective, where the Directorate General of Corrections ( Ditjenpas ) does not have a direct authority in supervising the prison. b . In the structure of law, the officers of the prison are still less in quality and quantity. c The lack of the participation and role of the society in the empowerment of the prisoners. This is because society still has a negative stigma against the prisoners. d The lack of the facilities and infrastructures in the process of empowerment of the prisoners in the prison. Limited facilities and infrastructure such as over capacity has created a particular sub of culture among prisoners that eventually raise some new problems. e However, some problems mentioned above do not influence the social relations between prisoners and the officers in the process of empowerment of prisoners. (2) .The implementation of the empowerment of the prisoner between government and private actor through Corporate Social Responsibility PT Holcim Indonesia Tbk Cilacap Plant in Nusakambangan: a. Indonesian law which expressly requires each investor to implement Corporate Social Responsibility through Act No. 25 of 2007 and it is required for the Limited Liability Company to implement the Social and Environmental Responsibility in accordance with the Law No. 40 of 2007 , is appropriate for the conditions in Indonesia at this time. b . CSR programs is needed by prisons in an effort to strengthen the empowerment of the prisoners. That is because the budget that allocated by the government for the empowerment of prisoners in the prisons is still insufficient. It is getting worst after the government cuts the budget in 2014 with no adequate reason. c . The existing problems for the empowerment of the prisoner needs a significant role from many parties, it can not be solved by the government itself, it requires the participation of the community and the business actor in a whole. d . Implementation of CSR PT . Holcim . Tbk . Cilacap Plant in Nusakambangan responded positively by stakeholders and in accoradance with the principles of the Triple Botton Line of Elkingto. e. CSR programs of PT Holcim . Tbk . Cilacap Plant for empowerment of the prisoners in Nusakambangan include : human capacity development , business capacity development, and the development of environmental capacity .f. CSR program of PT Holcim. Tbk. Cilacap Plant for empowerment of prisoners in Nusakambangan is covering the policy, institutional, energy, implementation, financing, monitoring, and control of empowerment. g. TheResults and benefits of CSR programs of PT Holcim Tbk Cilacap Plant in Nusakambangan are responded positively by stakeholders. Both inside and outside stakeholders. (3). Model for the empowerment of the prisoners through partnership programs between government and private actor especially by implementing Corporate Social Responsibility program in an effort to optimize the empowerment of the prisoners in the future is emphasized to: a. Strengthening the Partnership, b. Strengthening the Implementation of CSR, c. Strengthening the Development of the Empowerment of the prisoners
